Description: Concerned with the understanding of procedural criminal law. Examines the rationale underlying major court holdings, the procedural requirements that stem from these holdings, and their effect on the daily operations of the criminal justice system



MCCCD Official Course Competencies
1. Trace the development and the role of the United States Constitution in determining procedural requirements for the criminal justice system, including the concepts of judicial review and judicial interpretation. (I)
2. Outline and explain the role of the United States Supreme Court in determining procedural requirements for the criminal justice system, including the concepts of judicial review and judicial interpretation. (I)
3. Describe the significance of the first, fourth, fifth, sixth, eighth, and fourteenth amendments to the constitution and outline their relationship to procedural criminal law. (I)
4. Identify and describe the major cases relating to arrest, interrogation, and searches performed by police. (II)
5. Outline and describe the procedural requirements followed by the police in conducting arrests, interrogations, and searches. (II)
6. Identify and describe the major cases relating to pre-trial stages and procedures. (III)
7. Identify the stages of the pre-trial processes and describe the procedures to be followed in each stage of the process. (III)
8. Identify and describe major cases relating to sentencing, including capital cases, the appeal and appellate processes. (III)
9. Outline and describe the sentencing process including capital cases. (III)
10. Describe the appeal and appellate processes. (III)
11. Identify and describe major cases relating to corrections procedures including prison, probation, and parole. (IV)
12. Describe the procedural requirements relating to the corrections functions including prison, probation, and parole. (IV)
13. Describe procedural requirements for probation and parole revocation. (IV)
14. Identify and describe major cases influencing the procedural requirements of the juvenile justice system. (V)
15. Describe the procedural requirements of the juvenile justice system and indicate major procedural differences between the juvenile justice system and the adult criminal justice system. (V)
